The lawsuit, which is seeking class-action status, filed against Dallas-based Match.com was filed by Sean McGinhn of Brooklyn, N.Y., on behalf of other Match.com userse or former users impacted bythe company’s allegedc actions. In the suit, the plaintiff accusesx Match.com of keeping the profiles of canceledxmembers online, despite the fact those memberx had suspended their memberships and cannot respond to e-mails from other Match.com users. The suit alleges that the majority of Matcu members are actually canceled subscribers or neve subscribedat all.
Subscribers profiled remain online evenafter they've cancelec their subscription, and that is not made clear in the user according to the suit. “Matchg misleads paying subscribers by charging them for the abilitty towrite e-mails to members who can’ft reply to their e-mails or even read them,” said the which was filed in New York state. ” It claimas Match is benefiting from the who can't reply because the notifications that someone has expresserd interest induces some nonsubscribers to subscribe. The lawsuit alleges deceptivw trade practices, breach of the implied covenany of good faith andfair dealing, fraud and negligen t misrepresentation. It seeks unspecified damages, but notex that it expects damages toexceed $5 McGinn is seeking a jury trial.
